1. Agreement to Terms

These Terms of Use ("Terms") form a binding agreement between you ("User," "You," "Your") and Aquileia Asset Management GmbH ("Castle Collector," "We," "Us," "Our," "Company"). By accessing, browsing, or using the Castle Collector platform (the "Platform"), you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Platform.

2. Description of Service

Castle Collector is a real estate curation platform that acts as an intermediate marketplace between:

• Castle Collectors (Buyers seeking to purchase properties)
• Property Owners and Real Estate Agents/Agencies (Sellers)

We are not the owner of any listings. Castle Collector curates and displays property listings from various sources. We facilitate connections between interested buyers and sellers but do not charge fees to either party.

3. User Eligibility

To use Castle Collector, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Reside in a jurisdiction where Castle Collector operates
• Not be prohibited from using the Platform by applicable law
• Provide accurate, current, and complete information during registration

Your use of Castle Collector is personal and non-transferable. You agree not to share your account with others.

You agree not to use Castle Collector for any unlawful or prohibited purpose. Specifically, you will not:

• Engage in any illegal or fraudulent activity
• Post misleading, defamatory, or false information
• Harass, threaten, abuse, or discriminate against other users
• Collect personal information from other users without consent
• Use the Platform to facilitate money laundering or fraud
• Infringe on others' intellectual property or privacy rights
• Post spam, malware, or viruses
• Attempt to gain unauthorized access to the Platform
• Use automated bots or scrapers to access the Platform

8. Communication Between Users

Castle Collector facilitates communication between buyers and sellers/agents. Any agreements, contracts, or transactions between users are solely between those parties. Castle Collector is not responsible for disputes between buyers and sellers, fraudulent transactions or misrepresentations, non-performance or breach of contracts between users, or financial loss arising from transactions.

We recommend users conduct thorough due diligence and consult legal professionals before entering into property transactions.

9. Limitation of Liability

To the fullest extent permitted by law, Aquileia Asset Management GmbH and its officers, directors, employees, and agents are not liable for indirect, incidental, consequential, special, or punitive damages; loss of profits, revenue, data, or business opportunities; damages arising from user disputes or transactions; inaccuracies in listing information; or interruptions, delays, or errors in the Platform.

Our total liability to you is limited to the greatest of: (a) the amount you paid to us (if any), or (b) €100.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose, accuracy or completeness of listing information, non-infringement of third-party rights, absence of viruses or harmful code, and availability or uninterrupted service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aquileia Asset Management GmbH and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, your violation of applicable law, your infringement of third-party rights, or disputes arising from your transactions with other users.

12. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles. You irrevocably consent to the exclusive jurisdiction of the courts of Austria for any disputes arising from these Terms or your use of Castle Collector.

13. Dispute Resolution

Before initiating any legal proceedings, you and Castle Collector agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, disputes may be submitted to mediation or, if necessary, litigation in Austrian courts.

14. Fee Structure

Castle Collector does not charge any fees to buyers or sellers/real estate agents for using the Platform. The service is provided free of charge. However, this policy may be subject to change with 30 days' notice.

15. Reporting and Community Standards

Castle Collector maintains community standards to ensure a safe, trustworthy platform. Users can report fraudulent or misleading listings, inappropriate or offensive content, harassment or abusive behavior, and violations of these Terms. Reports are reviewed and investigated. Upon substantiation, problematic content will be removed, and users may face account suspension or termination.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Significant changes will be notified via email or a prominent notice on the Platform. Your continued use of Castle Collector after changes constitutes your acceptance of the updated Terms.

17. Termination of Service

Aquileia Asset Management GmbH may suspend or terminate access to Castle Collector at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Castle Collector regarding your use of the Platform. They supersede all prior and contemporaneous agreements, understandings, and negotiations.
